Piamo
Terms of Use
Effective:
These Terms of Use (“Terms”) govern your use of the Piamo app (“Piamo”, “the App”), made by Pixeldea, based in British Columbia, Canada (“we”, “us”). By downloading or using Piamo, you agree to these Terms. If you don’t agree, please don’t use the App.
These Terms work together with Apple’s Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If the two conflict, these Terms apply to the extent the law allows.
1. The App
Piamo teaches piano through songs, lessons and practice games played on an on-screen keyboard. We may add, change or remove songs, levels and features over time.
2. Subscriptions
Piamo requires a subscription to Piamo Pro. Available plans:
- Annual: billed yearly, with a free trial for eligible new subscribers
- Monthly: billed monthly
The price, billing period and any trial are shown in the App before you buy, in your local currency.
- Payment: payment is charged to your Apple ID account when you confirm the purchase, or when the free trial ends.
- Auto-renewal: subscriptions renew automatically at the same price and billing period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
- Free trial: if you’re eligible for a free trial, you won’t be charged during the trial. If you don’t cancel at least 24 hours before it ends, your subscription starts and you are charged. Each Apple ID can use the free trial once. Any unused part of a trial ends when you buy a subscription.
- Cancelling: you can manage or cancel your subscription in Settings → your name → Subscriptions on your iPhone. When you cancel, you keep access until the end of the period you’ve paid for.
- Refunds: purchases are processed by Apple. Refund requests are handled by Apple at https://reportaproblem.apple.com, under Apple’s policies.
- Price changes: if the price of your subscription changes, Apple will notify you in advance as required, and you can cancel before the new price applies.
3. Licence to use Piamo
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for your own non-commercial use, as allowed by these Terms and Apple’s rules.
You agree not to:
- copy, modify, reverse engineer or redistribute the App or its content, except where the law allows
- get around the subscription or any access restrictions
- use the App in any unlawful way
4. Content and intellectual property
The App, including its design, artwork, arrangements, text and software, is owned by us or our licensors and is protected by intellectual property laws. Song titles and composers’ names are used to identify the music. Nothing in these Terms gives you ownership of any content.
5. Your device and data
Your progress is stored on your device. If you delete the App or reset it, your progress may be lost, and we can’t restore it. Our handling of information is described in the Piamo Privacy Policy.
6. Disclaimers
Piamo is provided “as is” and “as available”. We work to keep it reliable, but we don’t guarantee that it will be error-free or uninterrupted, or that it will meet any specific learning outcome.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data or profits, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for Piamo in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
8. Ending these Terms
You can stop using Piamo at any time. We may suspend or end your access if you seriously breach these Terms. Sections 4, 6, 7 and 9 continue after these Terms end.
9. Governing law
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, unless the consumer laws of your country give you the right to rely on local law and courts.
10. Changes to these Terms
We may update these Terms. If we make material changes, we’ll update the effective date and show the new version in the App. Continuing to use Piamo after changes means you accept the updated Terms.
