Nestlist
Terms of Use
Effective:
These Terms of Use (“Terms”) govern your use of the Nestlist app for iPhone and its related services (“Nestlist”, “the App”), made by Pixeldea, based in British Columbia, Canada (“we”, “us”). By downloading or using Nestlist, you agree to these Terms and to the Nestlist Privacy Policy. If you don’t agree, please don’t use the App.
These Terms work together with Apple’s Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If the two conflict, these Terms apply to the extent the law allows.
1. What Nestlist does
Nestlist helps you organize a rental home search with the people you’re moving with. You can save listings from rental sites to a shared board, rate and discuss them, track each listing’s status, draft messages to landlords and follow a move-in checklist.
Nestlist is an organizing tool. We are not a landlord, property manager, real estate brokerage or listing service. We don’t own, verify or guarantee any listing, and we’re not a party to any agreement between you and a landlord.
2. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to use Nestlist. You need an account to use shared boards. Keep your sign-in details secure and tell us if you think someone has accessed your account without permission. You’re responsible for activity on your account.
3. Shared boards and your content
You keep ownership of what you add to Nestlist, including notes, ratings and messages. You give us permission to store, display and process that content only as needed to run the App and show it to the members of your boards.
Anyone with a board’s invite code can join that board and see its listings, ratings, shared notes and chat. Share invite codes only with people you trust. You’re responsible for what you share, and you must have the right to share it.
When you save listings from other websites, you’re responsible for using those websites in line with their own terms.
4. Message writer
The message writer creates ready-to-send drafts from templates, the listing and your renter profile. Drafts are suggestions. Review and edit every message before you send it; you’re responsible for the messages you send to landlords and for their accuracy.
5. Subscriptions
Nestlist is free to download. Optional auto-renewing subscriptions are available, billed monthly, every 3 months or yearly. The features included, price and billing period are shown in the App before you buy, in your local currency.
- Payment: payment is charged to your Apple ID account when you confirm the purchase, or when a free trial ends if one is offered.
- Auto-renewal: subscriptions renew automatically at the same price and billing period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
- Cancelling: you can manage or cancel your subscription in Settings → your name → Subscriptions on your iPhone. When you cancel, you keep access until the end of the period you’ve paid for.
- Restoring purchases: you can restore an active subscription on a new device from within the App.
- Refunds: purchases are processed by Apple. Refund requests are handled by Apple at https://reportaproblem.apple.com, under Apple’s policies.
- Price changes: if the price of your subscription changes, Apple will notify you in advance as required, and you can cancel before the new price applies.
6. Acceptable use
You agree not to:
- use Nestlist for anything unlawful, fraudulent or harmful
- harass, threaten or abuse other people, including other board members and landlords
- upload content that infringes someone else’s rights or that you don’t have permission to share
- copy, modify, reverse engineer or redistribute the App, except where the law allows
- get around the subscription or any access restrictions
- interfere with or disrupt the App or its servers
7. Third-party sites and services
Nestlist links to and opens websites we don’t control, such as Facebook Marketplace, Kijiji, Craigslist, Zumper, Rentals.ca, Realtor.ca and PadMapper. Those sites and their listings are governed by their own terms and privacy policies. Nestlist is not affiliated with or endorsed by them, and their names and logos belong to their owners.
8. Intellectual property
The App, including its design, artwork, mascot, text, templates and software, is owned by us or our licensors and is protected by intellectual property laws. Nothing in these Terms gives you ownership of the App or its content.
9. Disclaimers
Nestlist is provided “as is” and “as available”. We work to keep it reliable, but we don’t guarantee that it will be error-free or uninterrupted. We don’t guarantee that listing details are accurate or current, that landlords will respond, or that you will find or secure a home. The move-in checklist is general guidance, not legal, financial or insurance advice.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, money, housing opportunity or profits, arising from your use of the App or from any listing, landlord or third-party site. Our total liability for any claim relating to the App is limited to the greater of CAD $100 or the amount you paid for Nestlist in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
11. Ending these Terms
You can stop using Nestlist and delete your account at any time in Profile → Delete Account. We may suspend or end your access if you seriously or repeatedly breach these Terms. Sections 3, 8, 9, 10 and 12 continue after these Terms end.
12. Governing law
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, unless the consumer laws of your country or province give you the right to rely on local law and courts.
13. Changes to these Terms
We may update these Terms. If we make material changes, we’ll update the effective date and let you know in the App. Continuing to use Nestlist after changes means you accept the updated Terms.
14. Apple App Store terms
These Terms are between you and Pixeldea, not Apple. Apple is not responsible for the App, its content, maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; Apple has no other warranty obligation for the App. Apple is not responsible for any claims relating to the App, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
